FERPA Compliance

MarkTrack complies with the Family Educational Rights and Privacy Act (FERPA). We understand that student educational records are protected under FERPA, and we act as a service provider to schools. We do not disclose student information to third parties except as directed by the school or as required by law.

We do not sell or rent student information to third parties. We may share information only in the following circumstances:

Mobile Information and Text Messaging

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services on our behalf, such as customer service or message delivery, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Mobile numbers are provided by parents and guardians when they enroll a student and are used only to deliver the school notifications they consented to receive. Data Security

We implement appropriate technical and organizational security measures to protect your information against unauthorized access, alteration, disclosure, or destruction. This includes encryption, secure authentication, regular backups, and access controls. However, no method of transmission over the internet is 100% secure.

We retain student and school information for as long as your account is active or as needed to provide services. When you close your account, we will delete or anonymize your data within a reasonable timeframe, unless retention is required by law or for legitimate business purposes.

• Request deletion of your data (subject to legal requirements)

Children's Privacy

MarkTrack is designed for use by schools to manage student information. We comply with the Children's Online Privacy Protection Act (COPPA) and obtain consent from schools (acting in loco parentis) before collecting information from children under 13. We do not knowingly collect personal information from children without proper authorization.

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last updated" date. Your continued use of MarkTrack after such changes constitutes acceptance of the updated policy.
